CNIPA Accelerated Patent Examination at ARIPO

Do you have a patent whose claims have been determined to be patentable by China National Intellectual Property Administration (CNIPA) as the Office of Earlier Examination (OEE)?

As African Regional Intellectual Property Organization (ARIPO) registered agent, we shall help you apply for an accelerated examination at the ARIPO as an Office of Later Examination (OLE). We shall help with the filling of the required form and the submission of all the required information, including the request for substantive examination.

The benefits of requesting Accelerated Examination are that, the application will be expedited under the Harare Protocol and ARIPO will consider work performed prior by the CNIPA.

This approach is based on the agreement between the African Regional Intellectual Property Organization (ARIPO) and the China National Intellectual Property Administration (CNIPA) in the “Joint Statement of Intent for Cooperation in the Field of Patent Prosecution Highway (PPH)” signed in Geneva on 2nd October, 2017 by the representatives of the two offices which become effective on 8th of June 2024 for a trial period of five (5) years.

Currently, ARIPO is mandated to grant patents on behalf of the 20 Harare Protocol Contracting States, namely; Botswana, Cabo Verde, Kingdom of Eswatini, The Gambia, Ghana, Kenya, Kingdom of Lesotho, Liberia, Malawi, Mozambique, Namibia, Rwanda, Sao Tome and Principe, Sierra Leone, Seychelles, Sudan, Tanzania, Uganda, Zambia and Zimbabwe
