TRADEMARK OPPOSITION IN TANZANIA

1. Grounds for Trademark Opposition:
   - The grounds for opposing a trademark registration in Tanzania are outlined in the Trademarks and Service Marks Act of Tanzania.
   - Grounds for opposition include similarity or identity to an earlier registered trademark, lack of distinctiveness, descriptiveness, bad faith registration, likelihood of confusion, and imitation of official signs without authorization.

2. Filing of Opposition:
   - Any individual or entity can file an opposition to a trademark application within the prescribed period after its publication in the Trademarks Journal.
   - The opposition must be filed with the Registry of Trademarks in Tanzania and should clearly state the grounds for opposition.

3. Response to Opposition:
   - Upon receipt of the opposition, the Registrar will notify the applicant of the opposition and provide an opportunity to respond.
   - The applicant must file a counter-statement addressing the grounds for opposition within the specified time frame.
   - Failure to respond may result in the application being abandoned.

4. Hearing and Decision:
   - The Registrar will consider the opposition and the response before making a decision on whether to register the trademark.
   - If the opposition is upheld, the trademark application may be refused or accepted subject to conditions or limitations.

5. Appeals:
   - Both the applicant and the opposing party have the right to appeal the Registrar's decision to the High Court of Tanzania.
   - The High Court will review the case, consider the evidence presented, and make a final determination on the trademark registration.

6. Registration:
   - If no opposition is received or the opposition is decided in favor of the applicant, the trademark will proceed to registration.
   - The registered trademark will be protected under Tanzanian law and date back to the application submission date.
